TERMS AND CONDITIONS

Please note that by making your deposit payment to The Quirky Wedding Florist, this is you agreeing with the following T&Cs set by The Quirky Wedding Florist.

The Quirky Wedding Florist (“the Company”)

Any person(s), firm or limited company trading with the Company (“the Customer”)

Booking

A booking fee of £250 is required to secure your order on the date requested.

The booking fee secures your wedding date within the Company’s diary and is non-refundable and non-transferable.

The booking fee will be deducted from your final bill.

Payment

Full payment is required following your final design consultation and must be received by the agreed due date confirmed during your final meeting (typically within 2 days of the consultation).

The Company will not order flowers, sundries or commence work on the Customer’s wedding flowers until cleared funds have been received.

Failure to make payment by the agreed due date may result in delays to ordering and production. The Company accepts no responsibility for any resulting delays where payment has not been received on time.

A £25 administration fee will be added to any invoice not paid by the agreed due date.

If payment remains outstanding, the Company reserves the right to suspend work or cancel the booking without financial liability.

All payments are to be made via bank transfer. Credit Card or payments over the phone are not supported

All costs are inclusive of VAT at the prevailing rate.

Flowers, Foliage & Sundries

As the Company will be providing a changing product please be aware that the quality and colours may differ slightly to those discussed and agreed, depending on season and availability.

The Company reserve the right to substitute what the Company deems as suitable alternative sundries, foliage and flowers from those agreed. We endeavor to keep the designs and finished work as close to the agreed requirements as possible.

Flowers and other plant material are for display purposes only and NOT for consumption.

All flowers, arrangements and sundries supplied by the Company are purchased by the Customer and are theirs to keep following the wedding unless otherwise agreed in writing.

Collection & Delivery

Flowers may be collected, delivered or posted as agreed prior to the wedding.

Where flowers are posted, they will be sent via Royal Mail Special Delivery unless otherwise agreed in writing.

The Company cannot accept responsibility for delays caused by Royal Mail or other third-party couriers once the order has been dispatched.

Upon collection or delivery, responsibility for the safe handling, storage and transportation of the flowers transfers to the Customer.

The Company cannot accept responsibility for accidental damage occurring after the flowers have been collected or delivered.

Hired Items

The Company will charge the Customer a deposit for any hired items.

All hired items must be returned by the Customer, clean and undamaged, within 3 days of the event.

The Company reserves the right to make additional charges in respect of any loss of and/or damage to the hired items.

A 'clear down' fee will be charged to the Customer should the Company be required to clear down and carry away items at the venue after the event.

Liability

The Company shall not be liable for any breach of copyrights, trademarks or rights of privacy or publicity relating to materials supplied by the Customer.

The Company shall not be liable for any loss or damage caused to any third party arising out of any work carried out by the Company for the Customer.

The Company expressly excludes liability for special indirect or consequential losses which may arise including the Customer's loss of profit, business revenue, goodwill or anticipated savings.

The Company will not be held responsible for loss or damage caused as a result of a third party or environmental issues associated with the venue.

In the event that the Company is held liable to the Customer in respect of direct damage caused by the Company's breach, such liability shall be limited to the total amount of monies paid to the Company by the Customer under the terms of the relevant contract. The Customer agrees that this shall constitute its exclusive remedy.

The Company reserves the right to supplement and/or amend these terms and conditions from time to time.

Cancellation and Changes

Cancellation of this agreement should be made no later than 84 days prior to the agreed date of the event. At this time any monies paid, except booking fees, are fully refundable.

After this date the Company may charge for any expenses already incurred. Sundry items will be charged at cost prices plus VAT. Time and travel will be charged at a rate the Company deem reasonable.

If a cancellation of the agreement is received within the 84 days prior to the event no payments received will be refunded.

All cancellation notifications must be received by the Company in writing and signed by the Customer.

Any bespoke flowers already designed or completed prior to cancellation remain the property of the Company.

The Company reserves the right to cancel this contract if at any time the Company feel that the obligations cannot be met.

Changes may be made to your order following payment of the booking fee, subject to availability and agreement by the Company.

The overall value of the order may not be reduced by more than 10% of the original accepted quotation.

Any additional items requested will be charged at the Company’s current prices.

Photographs

The Company reserves the right to photograph completed work and use these images for marketing, social media, website and portfolio purposes unless the Customer requests otherwise in writing.

Design

Inspiration images are used as a guide only. As every design is bespoke, the Company does not replicate another florist’s work exactly.

Artificial Flowers

The Company specialises exclusively in high-quality artificial wedding flowers.

Whilst every effort is made to source the most realistic flowers available, exact flower varieties and colours cannot always be guaranteed.

Final approval of designs must be given during the final design consultation. Any requests for changes after this point may not be possible due to ordering and production schedules

By making the deposit payment invoiced for, you agree to the above terms and conditions.
